These Terms of Use ("Terms") govern your access to and use of the Motionfy application ("App") and website at motionfy.app ("Service"), operated by Motionfy ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age (or 16 in the EU/EEA) to use Motionfy. By using the Service, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes. This license does not include the right to sublicense, modify, reverse-engineer, or create derivative works of the App.

3. Your Content & Uploaded Photos

You retain ownership of any photos you upload to Motionfy ("Your Content"). By uploading content, you grant us a limited, worldwide, royalty-free license to process Your Content solely to provide the requested AI transformation service. This license ends when processing is complete and the content is deleted (within 24 hours).

You represent and warrant that:

• You own or have the necessary rights to upload the photos you submit
• You have obtained consent from any individuals depicted in photos you upload, particularly for face-based transformations
• Your Content does not violate any applicable law or third-party rights
• You are not uploading photos of minors for AI transformation purposes

4. AI-Generated Content & Copyright

The AI-generated images and videos produced by Motionfy ("Generated Content") are created by automated AI models. Ownership of Generated Content is as follows:

• You own the Generated Content produced from Your Content, subject to these Terms
• We retain no commercial rights to Generated Content derived from your personal photos
• Generated Content may incorporate stylistic elements from AI training data; we make no warranty of originality or copyright clearance for style references
• You are solely responsible for how you use, share, or publish Generated Content

AI-generated outputs may not be registered for copyright in some jurisdictions (including the United States, per current USPTO and Copyright Office guidance). You acknowledge this limitation.

5. Prohibited Uses

You agree not to use Motionfy to:

• Upload photos of individuals without their consent, particularly for realistic face-swap or deepfake-style outputs
• Create non-consensual intimate imagery (NCII) or any content that sexualises real people without consent
• Generate content that is defamatory, harassing, threatening, or designed to harm any person
• Create content that impersonates a real person in a misleading or harmful way
• Generate content involving minors in any sexualised context
• Upload photos you do not have the right to use
• Use the Service for commercial deepfake production or disinformation campaigns
• Attempt to reverse-engineer, scrape, or replicate our AI models or infrastructure
• Use automated scripts to access or use the Service without authorisation

Violation of these prohibitions may result in immediate termination of your account and, where appropriate, referral to law enforcement.

6. Subscriptions & Payments

Motionfy offers auto-renewable subscription plans. By subscribing, you agree to the following:

• Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annual periods as selected)
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• All billing is managed by Apple App Store or Google Play; we do not process or store payment information
• To cancel: iOS — Settings → Apple ID → Subscriptions; Android — Google Play → Subscriptions
• Refunds are subject to Apple's and Google's respective refund policies
• We reserve the right to change subscription pricing with reasonable advance notice

7. Intellectual Property

All intellectual property in the App — including but not limited to the software, design, AI models, trademarks, logos, and brand elements — is owned by Motionfy and is protected by applicable intellectual property laws. Nothing in these Terms grants you rights to our intellectual property other than the limited license described in Section 2.

8. Third-Party Content & Style References

Certain AI styles available in the App may reference artistic styles, visual aesthetics, or cinematic genres. We do not claim to reproduce copyrighted works; AI style transfer operates on learned aesthetic representations. We accept no liability for claims arising from the stylistic similarity of Generated Content to third-party works.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated outputs may contain artefacts, inaccuracies, or unexpected results.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOTIONFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Motionfy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) Generated Content you create, share, or publish; or (d) your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct harmful to the Service, other users, or third parties. You may stop using the Service at any time by deleting the App.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising out of or relating to these Terms shall be subject to binding individual arbitration, except for claims that qualify for small claims court. You waive your right to participate in class-action lawsuits or class-wide arbitration.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notice or email (if provided) with at least 7 days' notice before taking effect. Continued use of the Service after changes constitutes acceptance.
